One can apply for a divorce in Singapore if both husband and wife fulfil one of the following conditions:

• Singapore Citizen or Permanent Resident
• Domiciled in Singapore
• Lived in Singapore for more than 3 years

Both husband and wife has to be married for at least 3 years before one can file for a divorce. However, the Court may grant an application of divorce if one can prove that exceptional hardship can be proven, such as abuse and mistreatment.

A divorce is only granted if one is able to prove that the marriage is “irretrievable broken down”. This would mean that one would find it intolerable to live the spouse. A divorce could be granted if one is able to provide evidence on the following grounds:

• Adultery - It is whereby one party has been unfaithful and been caught having sex another person.
• Unreasonable Behaviour - is a really broad term. It could include physical abuse, emotional abuse, alcoholism, gambling problems and squandering of money.
• Desertion - It is whereby one party has been left alone with support for a continuous period of 2 years without any intention of returning.
• Separation for 3 years - It is whereby both parties have lived apart for a continuous period of at least 3 years. Consent by both parties is required.
• Separation for 4 years - It is whereby both parties have lived apart for a continuous period of at least 4 years. Consent by the Defendant is not required.
